Under the old law, dog owners were given what was described as a "one bite rule." In other words, liability typically would not attach to a dog owner if the dog had never bitten someone before. The one-bite-rule no longer exists in North Carolina. Under the current law, a dog owner may be held liable if he or she knows or should know that the dog possesses a vicious propensity and fails to take reasonable steps to prevent injury to other persons. Dangerous dogs include dogs that have killed or inflicted serious injury on a person or have been raised for dog fighting. Potentially dangerous dogs include dogs that have bitten a person, killed or inflicted injury upon another domestic animal when not on the owner's property, or approached a person when not on the owner's property in a vicious or terrorizing manner in an apparent attitude of attack. In addition, certain breeds of dogs (i.e. Rottweilers) are recognized as being aggressive by nature and therefore an owner may be negligent for not keeping the animal properly restrained.
